Viability Appraisals

We work with developers, local authorities and landowners to devise and review financial viability assessments for a range of purposes, including establishing the maximum reasonable proportion of affordable housing alongside other planning policy requirements, justifying the loss of employment floorspace, enabling development in heritage cases, affordable workspace, supporting grant applications, and payment in lieu calculations.

Section 106 Negotiations

We work with a range of clients on the terms of Section 106 agreements including affordable housing provision and early, mid and late review clauses.

Expert Witness

Our partners appear as expert witnesses at a range of planning appeals including hearings and inquiries, as well as supporting local planning authorities at examinations in public. In addition, our partners have provided expert witness advice on legal disputes relating to development viability and completed development assets to a range of tribunals.

Our team has extensive experience of testing the viability of local plan policies and CIL rates on behalf of local planning authorities to ensure compliance with the NPPF and the PPG. We support local authority clients through the consultation stages and at Examination in Public.
